Boots joins ZKS!

Brittany Boots joined Zuger Kirmis & Smith in September of 2016. Brittany graduated from Minnesota State Community and Technical College in May of 2014 with her associates in paralegal studies. Brittany worked in criminal prosecution and family law before joining the firm.

John Ward wins North Dakota Supreme Court argument

John Ward successfully briefed and argued a consolidated appeal before the North Dakota Supreme Court. The two cases, consolidated on appeal, involved default judgments obtained by two separate oil field service companies against common defendants. Two of the three defendants, represented by counsel, moved to vacate the default judgments in the district court alleging insufficient service of process and an insufficient basis for piercing the corporate veil. The district court denied the various defendants' motions to vacate. The defendants appealed the district court's decision to the North Dakota Supreme Court, which unanimously affirmed the district court's decision in an opinion (2016 ND 176) written by Justice McEvers.

Lindy Gandy joined ZKS as a paralegal in May of 2015. She works primarily in the area of litigation support. Lindy handles cases involving personal injury, product defects, construction litigation and health law. Lindy Graduated from Globe University (formerly Minnesota School of Business) in Moorhead, MN, with her Associate in Applied Science Degree in December of 2013. Lindy is an active member of Western Dakota Association of Legal Assistants and was Secretary/Treasurer for P.I.T. Crew (Paralegals in Training) during schooling.

Justin Balzer, originally from Bismarck, has joined ZKS as an Associate attorney primarily working in the area of litigation. Justin graduated from Bismarck High School and went on to get his law degree from UND. Justin was an Assistant Morton County State's Attorney for 2 1/2 years before joining ZKS in January of 2016.

Community Service - King elected President of Bismarck School Board

ZKS has a long history of being active in the community and bar association. Recently King, who is serving his 7th year on the Bismarck Public School Board, was elected President for the 3rd time.
 

King argues Supreme Court case in Public and Private Nuisance Claim in Oilfield Support Service case


11/03/2014
Lawrence King successfully defended an Oil Field support service company against a claim their business activities constituted a public and private nuisance. The McKenzie County jury ruled in favor of the company in October of 2013. The plaintiff appealed the jury verdict to the North Dakota Supreme Court which heard oral argument on October 29. A decision is expected within 30-60 days.
